Royal Shell Vacations - Terms and Conditions

IMPORTANT INFORMATION
Please read the following information carefully - All or part of the following may pertain to your reservation

Security:
In lieu of a security deposit, we request that a major credit card be presented at reservation or arrival. By acceptance the guest agrees to pay for any damages to the rental property not resulting from normal wear and tear, as well as charges incurred during stay, including by not limited to telephone charges, maid service, equipment rental, resort amenity privileges, keys not returned to RSV office, etc. and authorizes RSV to charge for same. In the event that an additional security deposit is collected above and beyond the rental amount, the deposit will be returned (less any charges) in approximately 6-8 weeks.

Cancellation Policy:
All cancellations are subject to a $35 administrative fee. Royal Shell Vacations will retain all prepaid funds should you cancel less than 90 days prior to arrival unless the property is rebooked for the same dates and rate. A partial refund may be applicable for the same dates booked at an adjusted rate. Optional trip insurance is available that can help to protect you from unforeseeable circumstances that may be reason for cancellation.

Confirmation:
Confirmation of property is established when a deposit is made. All payment and cancellation policies are placed in effect at that time. Any refunds due to guests will be sent in check form, less administrative fees.

Payment by cheque:
Final payment must be made by personal cheque, cashier’s cheque, or money order. Cheques must be payable in US funds, otherwise any bank fees to convert to US funds will be the guest’s responsibility. No post dated cheques will be accepted. Returned cheques will be charged a $35 service fee plus applicable bank charges not to exceed $50. Wire transfer fees are subject to a $25 fee. Office administrative fees will be charged a 3% fee when paying by means other than cheque.

Acts of nature:
RSV cannot be held liable for any acts of nature or occurrences beyond our control. No rate adjustments will be made.

Quiet Use and Enjoyment:
RSV does not guarantee quiet use or enjoyment of properties due to noise from other persons, construction, maintenance, etc. from neighbouring properties and will not grant a rebate for circumstances originating outside the property.

Maintenance:
In the event of equipment malfunction, RSV will expedite repairs as quickly as possible. From time to time, it may be necessary to close tennis courts, swimming pools and other amenities for maintenance purposes. Any maintenance items should be reported to RSV as soon as possible. No rent adjustments can be made for circumstances beyond our control or for malfunction or loss of use of equipment or amenities.

Maid Service/Special Requests:
While linens and bath towels are included in each unit, daily maid service is not. Maid service, at and additional charge can be arranged with a minimum 24 hours notice. Preferences will be noted but not guaranteed. Cribs, rollaway beds and other child care or guest convenience items are offered at an additional charge.

Maximum Occupants:
The maximum number of guest’s allowed is set by the property owner and/or association. Exceeding these limits shall result in forfeiture of payments/deposits. Reservations obtained under false pretences will cause forfeiture of all payments.

Causeway Tolls:
To reach Sanibel Island, you must cross the causeway-round trip toll is $3.00.

Telephone Charges:
There is no charge for local telephone calls. Long distance calls must be placed on a calling or credit card. Direct dial long distance calls shall be billed to the guest and minimum handling fee of $2.50 per call shall be charged.

Misc. Charges:
A $10 charge will be made for all keys not returned to RSV office upon checkout. A full day rate will be applied to checkouts after 10 am.

Furnishings:
All of the properties are individually owned and decorated. The furnishings, appliances, equipment, style, quality, colours, etc. are provided solely by the owner. RSV does not accept liability for the aesthetic or functional perception of the units’ contents.

Parking:
Motor homes, boat trailers, travel trailers, etc. are not allowed. Please ask about local storage of such vehicles prior to travelling.

Substitutions of Accomodation:
We reserve the right to change unit assignments. When you confirm a reservation, a unit will be assigned, however, no unit request is guaranteed. Any difference in rate is subject to guest approval.

Pools:
Temperature settings are controlled by the owners or association and not all properties have pools. RSV is not responsible for pool and spa closures and malfunctions and no credit and/or discount can be granted for circumstances beyond RSV control.

Amenities:
Not all properties have tennis courts. RSV is not liable for malfunction or closure of property amenities and credits/discounts will not be offered.

Mail/Faxes:
Please arrange to have any mail sent to you in care of RSV at our address. Facsimile services shall be charged at a rate of $1.00 per page.

Student Groups:
Those under 21 must be accompanied by an adult. Reservations obtained under false pretences will cause forfeiture of all payments.

Pets:
Pets are not permitted in condominium complexes. In the event that a rental unit does accept a pet, RSV must be notified when making the reservation and a non-refundable pet fee is applied to the reservation.

Association Rules:
All accommodations are confirmed with the understanding that you will abide by all rules and regulations prescribed by individual owners, condominium or homeowner associations.

Interest of Bearing Account:
Deposits/prepayments may be placed in an interest bearing account. It is understood that RSV shall retain all interest earned.

Units for Sale:
In the event that the property which your are renting is listed for sale, we may find the need to show the property during your stay. We will make every attempt to schedule the showing at a convenient time so as not to disturb your vacation.

Agency Disclosure:
Royal Shell Vacations (RSV) serves as agent and representative of all owners of condominium units and resort dwellings in its rental program and is acting at all times in and for the best interest of the owner.

Vacation Protection Plan:
Royal Shell Vacations offers trip cancellation insurance which protects your deposit and full payment should unforeseen circumstances cause cancellation.

Hurricane Policy:
If you are travelling between May and November, please note that this is hurricane season. We would encourage you to purchase trip insurance to protect your investment as owners are not required to rebate rent in the event of a voluntary or mandatory evacuation.
